Thomas Penfold described his occupation at death as a butter searcher.

 

A searcher is given numerous definitions in the Compact Edition of the OED published 1979 with copyright Oxford University Press 1971. The Preface is dated August 1933 The complete text has been reproduced micrographically. Page 2696 contains page 354 of the letter S:

 

"Searcher:

1 ..........................

2 One whose office is to search a. An official appointed by a guild or company to resist the violation of its customs and laws, and to prevent the production of work below a certain standard of excellence. Obs.

1419 Engl. Misc (Surtees) 14 It was accorded and assented be bothe the partys that the sercheours of the masons and of the wryghtes of this cite of York suld ga and see what were ryght for another party. 1516 Nottingham Rec III 345 The Sercheres of the Fysheres..they suffer corupe fyshe and noght to be sold in the market. ......... d. As the designation of various municipal or government officials; e. g. a sanitary inspector; an inspector of markets; an examiner of certain articles o f manufacture that were not allowed to be sold unless certified by him as of standard quality, etc. Obs.

Estate Clothing iv 18 The best search made by the searchers in any place, is but to cast the Clothes into skales to see if they be weight or no. 1738 Act II (or 11) Geo II, c 28 ? 3 Which said searcher s shall and may have full Power .. to enter into and inspect all such Mills, Shops, Warehouses (etc.) of Makers, Merchants, or Dealers in Narrow Cloth. .............."

 

It would appear that a butter searcher was essentially a quality inspector for butter and may even been able to certify the quality and/or source

Thomas Penfold's connection to the Kingston upon Thames family is that

1 He mentions his brother John Wornham Penfold in his will

2 He signs a quit claim in 1739 saying he is the heir and executor of Ann Weaver of Chobham, Surrey and mentions James Simmons of Surrey and his wife Katherine, nee Penfold whose father Francis Penfold was nephew to Ann Weaver

3 A Thomas is mentioned by Hannah Penfold in her will dated Dec 1756

The last Will and Testament of me Thomas Penfold of the City of York Butter Searcher - First I Give devise and confirm All my Estates of whatsoever tenure or nature situate in the County of Surrey and all my Right and Title therein To my Son Thomas Penfold his Heirs and Assigns to his and their own use forever --- Item I Give and Devise All my Houses Warehouses Stables and Hereditaments Garden and Premisses situate and being in Micklegate and Fetter lane in the City of York aforesaid and all other my real Estate in the said city unto and to the use of my two Daughters Susannah Gurnell of Gainsborough in the County of Lincoln Widow and Ann the Wife of William Jackson of the said City of York Grocer ......... one clear Annuity of twenty pounds for the use of my Daughter Hannah Penfold for and during her Life, And one other clear Annuity of ten pounds for the use of my said Son Thomas Penfold during his Life, both the said Annuities to be paid into the hands of my Brother Mr John Wornham Penfold and John Swann and Thomas Swann both of the said City of York Merchants .... applied half yearly or oftener as they shall find it necessary for the Maintenance clothing and benefit of the said Annuitants ........ ---- Item I Give and bequeath unto my said Son Thomas and Daughter Hannah Penfold ten pounds apiece to be paid out of my Personal Estate immediately after my decease Item I Give and bequeath all the residue and remainder of my Personal Estate of any nature or kind whatsoever ..... To my said Daughters Susannah Gurnell and Ann Jackson equally ........ Note on Marriage to Mary SWAN

While Thomas Penfold is Ann Penfold's father, it is not clear whether Mary Swan was Ann's mother. She may well have been her step-mother. It was more than likely Ann was born before 1741 especially as her burial record implies she was born in 17 33.

There was another dau of Thomas since a witness at the marriage of William Jackson and Ann Penfold was Susanna Penfold
